We will here describe the genesis of the IOM (...) report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. Roger Kennedy has written a masterful investigation into the concept of evil. He begins with a general view of the subject before moving into more detailed analysis. First is a review of the science of evil, including evidence from neuroscience and social psychology. This is followed by psychoanalytical studies of the individual and groups before presenting an overview of the philosophy of evil. Also included are historical and social studies which inform an understanding of evil in action. Kennedy (...) goes on to examine the nature of genocide using a main focus on the Holocaust and of slavery. Both of these "journeys to evil" remain relevant for understanding contemporary society and issues. The Nazi past continues to disturb and resonate decades on. The politics and social fabric of Western society was reliant on slavery as a foundation of economic wealth and is haunted by its inability to process the harsh reality of slavery and its continuing after-effects. Kennedy moves from there to a discussion on the genius of Shakespeare and his encapsulation of the essential features of how evil can develop and take over a person's inner world. The book concludes with a summary of the main themes and a look at those who have resisted evil and what we can learn from them if we are to build a society that can resist the forces of evil. The book is informed by a psychoanalytic approach, with its emphasis on the power and influence of unconscious processes underlying human actions, and on the role of inner conflicting and elemental fears and anxieties often driving individual and group behaviours. In this interdisciplinary and wide-ranging study, Roger Kennedy looks at the roots of tolerance and intolerance as well as the role of the stranger and strangeness in provoking basic fears about our identity. He argues that a fear of a loss of attachment to one's home might account for many prejudiced and intolerant attitudes to refugees and migrants; that basic fears about being displaced by so-called 'strangers' from our precious and precarious sense of a psychic home can tear communities (...) apart, as well as lead to discrimination against those who appear to be different. Present day intolerance includes fears about the 'hordes' of immigrants confused with realistic fears about terrorist attacks, populist fears about loss of cultural integrity and with it a sense of powerlessness, and fearful debates about such basics as truth, including the so-called 'post truth' issue. Such fears, as explored in the book, mirror old arguments going back centuries to the early enlightenment thinkers and even before, when the parameters of discussion about tolerance were mainly around religious tolerance. There is urgency about addressing these kinds of issue once more at a time when the 'ground rules' of what makes for a civilized society seem to be under threat. Kennedy argues that society needs a 'tolerance process', in which critical thinking and respectful judgment can take place in an atmosphere of debate and reasonably open communication, when issues around what can and cannot be tolerated about different beliefs, practices and attitudes in people in our own and other cultures, are examined and debated. Tolerating Strangers in Intolerant Times, with the help of psychoanalytic, literary, social and political thinking, looks at what such a tolerance process could look like in a world increasingly prone to intolerance and prejudice. Nonprofit organizations play a crucial role in society. Unfortunately, many such organizations are chronically underfunded and struggle to meet their objectives. These facts have significant implications for corporate philanthropy and Kant’s notion of imperfect duties. Under the concept of imperfect duties, businesses would have wide discretion regarding which charities receive donations, how much money to give, and when such donations take place. A perceived problem with imperfect duties is that they can lead to moral laxity; that is, a failure on (...) the part of businesses to fulfill their financial obligations to nonprofit organizations. This article argues the problem of moral laxity rests on a misinterpretation of Kantian ethics and, therefore, is really not a problem at all. As such, we argue corporate philanthropy while an imperfect duty should be interpreted more akin to perfect duties and, as a consequence, moral laxity does not arise for those corporations committed to acting on the basis of the moral law. More specifically, firms have duty-based obligations on the basis of benevolence, and as good corporate citizens, to help fund non-profit organizations. (shrink)

The Confidentiality Advisory Group (CAG) is a specialised body that advises the Health Research Authority (HRA) and the Secretary of State for Health on requests for access to confidential information, in the absence of informed consent from its owners. Its primary role is to oversee the safe use of such information and to counsel the governing bodies mentioned above as to whether such use is appropriate or inappropriate. Researchers who seek access to England or Wales-based confidential data, for medical purposes (...) that are in the interest of the public, are typically required to submit an application to this body. However, it is not always clear to researchers whether requests for access to patient data fit within the remit of the CAG or a Trust’s local information governance team. H. L. A. Hart’s The Concept of Law (Hart 1994) contains many passages that have become iconic for legal theory. This essay focuses on Chapter 7, sections 1 and 2, and Hart’s comments about judicial discretion in the context of Ronald Dworkin’s well-known attack on the idea of judicial discretion in his essay “The Model of Rules”. Specifically, the paper undertakes three projects. The first project is to defend the importance of the fundamental picture that Hart presents in Concept, Chapter (...) 7 of Common-Law judicial rule-making. Hart represents such rule-making as a balance of certainty and flexibility, and he is correct to do that. The second project is to argue that Dworkin’s attack on the positivist model of common-law judicial rule-making as an exercise of “strong discretion” fails. The idea, central to the meaning of “strong discretion” that courts are not “not bound by standards set by the authority in question” cannot be established. The third is to argue that Hart is his own worst enemy. The language, metaphors and images he uses to present his account of common-law judicial rule-making open the way to Dworkin’s critique. They also reveal Hart, if the language, metaphors and images are taken seriously, to be precisely the kind of formalist or deductivist about adjudication that he is ostensibly in Concept Chapter 7 criticising.Resumen:El concepto de derecho (1994) de H. Within the nursing ethics literature, there has for some time now been a focus on the role and importance of character for nursing. An overarching rationale for this is the need to examine the sort of person one must be if one is to nurse well or be a good nurse. How one should be to live well or live a/the good life and to nurse well or be a good nurse seems to necessitate a focus on an agent's character (...) as well as actions because character is (for the most part) expressed in action (e.g. seeLaird). This paper will give an overview of the reasons for the role and importance of character in nursing practice and explain its relation to nursing's frequent use of virtue ethics in order to recommend caution. While the paper agrees that the role of character is important in nursing caution is needed in both how much moral and thus normative, emphasis is being placed on the psychology of character and on the drift to virtue ethics. The psychological which may be explanatory needs to be linked with the normative, and a justification for the normative is needed. A justification as virtue ethics is contested, and nursing practice does not need to take on this explanatory and justificatory burden.A tentative proposal raised but not discussed in depth in this paper is that when an ultimate explanation or explanatory ground is needed, nursing practice leads quite naturally to a form of consequentialism as well as a realist metaethic. On this account, there are two levels of moral thinking, and nursing practice entails the virtues at one level and leads quite naturally to moral thinking at another more critical level of the criterion of what makes something right and good independently of character. Boston: Wisdom Publications, 2001. 153 pp. Tom Chetwynd brings many strengths to his book of reflections on Zen and Christianity. Because his most obvious strength is his craft as a professional writer, he offers us a book that is well written, carefully organized, and a pleasure to read. He divides his (...) reflections into three parts: "Zen Experience," "Christian Meditation in the Light of Zen," and finally, "Christian Zen Practice." It is especially in the first and third parts that the author is particularly helpful for Christians engaged in interfaith dialogue.In part 1 Chetwynd's reflections on the Zen experience are autobiographical. He tells us that he came to Zen as a committed adult Christian who did not jettison his faith for another but rather labored to integrate his Christian faith and his Zen experience. Those of us who travel this very same path are familiar with the stages of Chetwynd's journey: in the first stage our attention is drawn to Zen by a random phrase in a book or by a friend's interest in Zen; then follows our first attempt to sit in a sesshin with others; then the experience of boredom, pain, and frustration, all of which give birth to the conviction that Zen might very well work for others but not for us. However, our first meeting with a charismatic roshi who inspires, encourages, and launches us back on the journey with the challenging and consoling words: "[You] can do it." These words help us both to ignore our fear and to sustain our resolve to sit with vigor to the last bell.What makes Chetwynd's experience so extraordinary and unique was the rapid opening of his mind. After his very first sitting, he tells us, he experienced his teacup "shining alone in empty space," and immediately following his first sesshin, Chetwynd reveals that his teacher, a Japanese monk, assured him that "he [the teacher] had nothing more to give [him/the student]." Chetwynd's experience very much reminds me of an incident that happened years ago in Tokyo. At a meeting with Kadowakii Roshi, he introduced me to a Mexican Jesuit who, the Roshi revealed, had experienced kensho during his first sesshin. I will always remember the Roshi's expression [End Page 174] of surprise and admiration as he uttered how wonderful and rare indeed was such an experience.Chetwynd is candid about the effect that the Zen experience has on his Christian faith: comparing his Zen experience to the latter, he confesses that his three years of theological study were "all for nothing"; he acknowledges that he believes he has received more insight from one week of Zen sitting than from the twenty-five years he practiced Christianity; he claims that while his Zen experience enables him to return to his Christian prayer and liturgy with new insight, it also makes him aware that while engaging in these spiritual exercises, he finds his heart is elsewhere. He goes on to reveal that he fears losing his faith because the idea of a godless universe "quite simply appall[s him]." Possibly adding to his quandary was Kyudo Roshi's reaction to Chetwynd's question about the value of the prayer of petition. On two occasions the author tells us that his teacher "chuckled" in response to his question about the prayer of petition. One would hope that in interreligious encounters with Christians, Zen teachers in their compassionate outreach would remember that what is amusing to them—the value of the prayer of petition and its opposite, a godless universe—is "quite simply appalling" to their Christian friends.Chetwynd's second part of the book, the story of Christian meditation in the light of the Zen experience, is extremely tentative. Despite its theoretical importance, little is known about how semantic memory structure facilitates and constrains creative idea generation. We examine whether the semantic richness of a concept has both benefits and costs to creative idea generation. Specifically, we tested whether cue set size—an index of semantic richness reflecting the average number of elements associated with a given concept—impacts the quantity (fluency) and quality (originality) of responses generated during the Alternate Uses Task (AUT). Across four studies, we show that low-association, sparse, (...) AUT cues benefit originality at the cost of fluency compared to high-association, rich, AUT cues. Furthermore, we found an interaction with individual differences in fluid intelligence in the low-association AUT cues, suggesting that constraints of sparse semantic knowledge can be overcome with top-down intervention. Our findings indicate that semantic richness differentially impacts the quality and quantity of generated ideas, and that cognitive control processes can facilitate idea production when conceptual knowledge is limited. In particular, Peikoff has conflated two different kinds of rationalists and empiricists and has completely overlooked combinations of the Platonist and so-called “Kantian” modes. As a result, his three pure integration “modes” actually produce not just two “mixtures” but a total of six. Cloth, $85.In his welcome book on the invention of ethnography, Skinner challenges the focus in mainstream scholarship on the Greek prose genre that was first defined by Jacoby (...) in his influential Die Fragmente der griechischen Historiker(discussed in detail, 30–34) and on a notion that the “Greekness” the genre embodies was [End Page 287]supposedly invented in the fifth century as a response to the Persian wars. Skinner also advocates a break from the structuralist frameworks favored by scholars such as F. Hartog and E. Hall. Thus, the book has two distinct focuses. First, Skinner seeks to demonstrate that the origins of the prose genre can be found in other literary genres, sub-literary engagements, and material artifacts that should be considered as part of the “thought-world from which the early prose accounts emerged” (17). Second, Skinner shows that structuralist binaries are not the best method for understanding ethnographic thinking and frames his study instead with the discourse theories found in the works of historian J. Clifford and anthropologist/sociologist P. Bourdieu that emphasize “practice” and process. Skinner argues that the genre of Greek ethnography is not synonymous with the practice of Greek identity nor can any functional, homogenous Greek identity claim to be embedded within the genre (18). Rather, he emphasizes the “ethnographic concerns” of the Greeks and attempts to contextualize the emergence of the prose genre by exploring evidence of ethnographic “practice” in the material of everyday life. Ethnographic thought is further defined as positioning in relation to both non-Greeks and other Greeks. Although the title of the book suggests that the timeframe of the study includes evidence from Homer down to the time of Herodotus’ Histories(ca. 430 b.c.e.), most of the evidence he musters comes from the archaic period with occasional recourse to Pindar and the historical fragments of the post–Persian war period. This fits in with a secondary aim of the book to show that the Persian wars did not serve as the impetus for ethnographic thinking or for the emergence of a notion of “Greekness,” a position emphasized most vigorously by J. Hall.Chapter 1 is a long and dense explanation of Skinner’s theoretical approach and the debates among which Skinner situates his study. Despite a number of scholarly efforts over the last decade or so in rethinking identity and ethnicity in antiquity, it is still necessary to combat the ghosts of Jacoby and the structuralists, and Skinner musters a theoretically equipped army for the battle. He finds inherently problematic Jacoby’s “invention” of genres and our adherence to them (a legacy from the earlier academic enterprise, especially in Germany, of prioritizing and ranking ancient cultures based on their “firsts”). Structuralist views are represented by Edith Hall’s Inventing the Barbarian(Oxford 1989), one of the most influential voices in the study of ancient ethnicity. Although she is prominent throughout the book, Skinner ironically never addresses the fact that Hall’s own evidence is the performative, public practice of Athenian drama. Hall herself, although a structuralist, reflects in choice of evidence the type of discursive practice Skinner himself wishes to invoke (in fact, he entirely excludes drama from his evidence). Skinner’s theoretical apparatus is complex and rarely appears explicitly in later chapters (except in the conclusion).In “Populating the Imaginaire” (chap. 2), Skinner catalogues some foreign and/or mythical peoples whom the Greeks deployed in their texts and art as part of their process of self-identification. In two studies, we explored the frequency and phenomenology of musical imagery. Study 1 used retrospective reports of musical imagery to assess the contribution of individual differences to imagery characteristics. Study 2 used an experience sampling design to assess the phenomenology of musical imagery over the course of one week in a sample of musicians and non-musicians. Both studies found episodes of musical imagery to be common and positive: people rarely wanted such experiences to end and often heard music that (...) was personally meaningful. Several variables predicted musical imagery, including personality, musical preferences, and positive mood. Musicians tended to hear musical imagery more often, but they reported less frequent episodes of deliberately-generated imagery. Taken together, the present research provides new insights into individual differences in musical imagery, and it supports the emerging view that such experiences are common, positive, and more voluntary than previously recognized. This paper aims to reconstruct the overarching logical structure of Michael Williams's response to philosophical skepticism. One goal is to forestall overhasty dismissals of his position based on failures to understand the logical relations among his various anti‐skeptical claims and arguments. In many places, Williams suggests that the strategy he calls “theoretical diagnosis” is sufficient to defuse the skeptical challenge and that, accordingly, his anti‐skeptical strategy consists solely in developing theoretical diagnoses. According to the account developed here, this claim is (...) misleading—in need of significant qualification, if not outright false. Even so, the paper concludes that, in its essentials, Williams's response is structurally sound, given his understanding of the problem posed by skepticism. I argue in this paper that, like the Pyrrhonism of Sextus Empiricus, Wittgenstein’s response to negative–dogmatic skepticism in On Certainty turns on the attempt to free us from the demands of traditional philosophy and is therefore not a philosophical position, strictly speaking. Rather, it is a therapeutic metaphilosophy designed to bring into view (i.e., to illumine) the relationship between our everyday epistemic practices and those of philosophy such that we simultaneously come to recognize (a) what I call the pragmatic–transcendental self–standingness (...) of the everyday and (b) its philosophical–rational groundlessness. The Pyrrhonian illumination of the everyday is therapeutic in that it aims to purify our metadoxastic attitudes of dogmatism. (shrink)
